GENERAL TERMS AND CONDITIONS

These conditions apply to all sales concluded by NAAD through the www websites.naadme.com

These conditions are only valid for individuals.

ARTICLE 1-PRICE

1.1-The prices of our products are indicated in the local currency and will include VAT for sales inside the E.U. and exclude VAT for sales outside the E.U. Shipping costs will cover both the cost of mailing as well as the cost of preparation and processing of the order.

1.2-For all orders shipped outside the E.U., customs duties or other local taxes or import duties or state taxes may be due. Such sums will be the full liability of the buyer towards the competent authorities.

1.3 - NAAD reserves the right to modify its prices at any time but the products will be invoiced on the basis of the prices in force at the time of validation of your order.

1.4 - The products remain the property of NAAD until full payment of the order.

ARTICLE 2-VALIDATION

You declare that you have read and accepted these general Conditions of sale before the order is made. The validation of your order means your acceptance of these general terms of sale.

ARTICLE 3 - AVAILABILITY

NAAD is not intended to sell the products offered in large quantities. Consequently, NAAD reserves the right to refuse orders for the same product in large quantities. Our products are available as long as they are visible on the site, and excluding promotional operations mentioned as such on the site. In the event of unavailability of a product after placing your order, we will inform you by email, and will then offer you the choice between refunding your order or replacing the unavailable product(s) with other products from our catalog.

ARTICLE 4-DELIVERY

4.1-General

The products will be delivered to the delivery address as indicated during the order process. The order shipment is made within 72 hours of the order, subject to availability of the product. The delivery times are generally 5 working days in metropolitan France, starting from the dispatch of the order, except in cases of force majeure (strikes, terrorist acts, wars, natural and meteorological disasters,...).

In case of check payment, the order will be sent upon our receipt of the payment.

4.2 - Restrictions

You must notify the carrier and NAAD of any reservations about the product delivered (for example: damaged package, already opened...). Depending on the cases defined in Article 9 below, you may benefit from the exchange and refund conditions provided for in this Article.

4.3 - Responsibilities

Deliveries are made to the address indicated in the order form which can only be in the agreed geographical area. The risks are borne by the purchaser from the time the products leave NAAD's premises. 

NAAD cannot then be held responsible for any loss or theft of your package during transport. No compensation other than that provided for in La Poste's general conditions, nor compensation may be required...

For Colissimo deliveries, the status available on http://www.colissimo.fr/suivi will be taken as proof. If the status indicates that the package is lost or damaged by the Post Office, NAAD will take care of the new shipment of your package.

4.4 - Missing or incorrect delivery information

If a parcel could not be delivered to you because the delivery address is incorrect or incomplete, then your parcel is automatically returned to our warehouse. In this case, we will reship the order at your own expense or we will refund the order excluding shipping costs.

ARTICLE 5 - PAYMENT

A aucun moment, les sommes encaissées ne pourront être considérées comme des arrhes ou des acomptes.

The payment of your order can be made by any of the following methods:

-credit card: Visa, MasterCard, American Express, other credit cards. The debit of the card is only made when the order is shipped.

-Paypal.

NAAD.me will not save in its databases the details of the credit cards used for the order payment.

ARTICLE 6 - SECURITY

Our website is hosted in a secure platform.

Our platform uses the SSL encryption process to protect as effectively as possible all our customer's sensitive data.

ARTICLE 7 - SATISFAIT OU REMBOURSÉ 14 JOURS - DROIT DE RÉTRACTATION

7.1 - In accordance with the legal provisions in force, you have 14 days from the receipt of your products to exercise your right of withdrawal from NAAD without having to justify your reasons or pay any penalty. NAAD extends this period to 30 calendar days, from the date of receipt of the order, in order to make only one exchange.

En cas d’exercice du droit de rétractation dans le délai susvisé, seul le prix du ou des produits achetés et les frais d’envoi seront remboursés; les frais de retour restant à votre charge.

Les retours sont à effectuer dans leur état d'origine et complets (emballage compris) et accompagnés d’une copie de la facture d'achat. Les produits ne doivent pas avoir été portés. Pour des raisons d’hygiène, les sous-vêtements ne pourront pas être retournés dans le cadre du droit de rétractation. Par conséquent, et sans préjudice des garanties légales, les sous-vêtements ne seront ni repris ni échangés. Attention: nous n'acceptons pas les retours en courrier recommandé.

Vous recevrez une notification lors de la réception du colis retourné, et le remboursement s’effectuera dans un délai de 30 jours.

Ce droit de rétractation n'est pas applicable aux produits personnalisés, conformément à l'article L121-20-2 du code de la consommation.

ARTICLE 7 - CONFORMITY OF PRODUCTS

We undertake to refund or exchange defective, damaged or damaged products or products that do not correspond to your order. In this case, please send us a detailed report by email to contact@naadme.com and send us a picture of the item concerned. We will then ask you to return the product(s) to us and NAAD will, at your option, exchange or refund the product(s). The return shipping costs will be refunded up to a maximum of €4.90 (Colissimo rate in force on 01/01/2017) upon presentation of supporting documents. In any case, you benefit from legal guarantees of conformity and hidden defects, in accordance with the legal provisions in force. The provisions of this article do not prevent you from benefiting from the right of withdrawal provided for in Article 7.

ARTICLE 8 - REFUND POLICY

Refunds of products in the cases referred to in Articles 7 and 8 shall be made as soon as possible and at the latest within 30 days of the date on which the right has been exercised. Refunds will be made on NAAD's proposal by crediting the customer's bank account or by bank cheque sent in the name of the customer who placed the order and to the billing address.

Si votre commande après retour ne satisfait plus nos conditions pour bénéficier de la gratuité des FDP (>70 euros), nous déduirons alors une participation aux frais d’expédition lors du remboursement.

ARTICLE 9 - INTELLECTUAL PROPERTY

All texts, comments, books, illustrations, works and images reproduced or represented on the NAAD website are strictly reserved under copyright and intellectual property law and for the whole world. As such and in accordance with the provisions of the Intellectual Property Code, only use for private purposes is authorized, subject to different or even more restrictive provisions of the Intellectual Property Code. Any reproduction or representation, in whole or in part, of any of the NAAD sites or any or all of the elements found on any of the NAAD sites is strictly prohibited.

ARTICLE 10 - LIABILITY

The products offered comply with current French legislation. NAAD shall not be held liable in the event of non-compliance with the legislation of the country to which the product is delivered.

ARTICLE 11-JURISDICTION

These terms and conditions are subject to the French legislation in force. In the event of a dispute, the French courts will be competent.

ARTICLE 12 - PERSONAL INFORMATION

The information and data concerning you are necessary for the management of your order and our commercial relations. They may be forwarded to companies that contribute to these relationships, such as those responsible for the execution of services and orders for their management, execution, processing and payment. This information and data is also stored for security purposes, to comply with legal and regulatory obligations and to enable us to improve and personalise the services we offer you and the information we send you. In accordance with the Data Protection Act of 6 January 1978, you have the right to access, rectify and oppose any personal data concerning you. In accordance with the regulations in force, your request must be signed and accompanied by a photocopy of an identity document bearing your signature and specify the address to which you must receive the reply. A reply will then be sent to you within 2 months of receipt of the request.
